The data provided by you are processed by the Data Controller in accordance with EU Regulation 679/2016 (the “Regulation”) to:
(i) respond to your requests for information on our products; the legal basis for the processing is art. 6.1. (f);
(ii) manage quality complaints relating to our products and fulfill obligations related to adverse event surveillance activities. Once the data, including health data, have been provided by you, we are obliged to process them to comply with legal obligations and/or to pursue a public interest (i.e. ensuring a high level of safety for our products); the legal basis for the processing is constituted by art. 6.1. (c) and 9.2 (i) of the Regulation.
We inform you that if you provide data of third parties, you guarantee us that you have been duly authorized to do so in full compliance with the applicable legislation.

In accordance with the provisions of art. 5.1.(c) of the Regulation, the information systems and computer programs used by the Company are configured in such a way as to minimize the use of personal and identifying data; such data are processed only to the extent necessary to achieve the purposes indicated in this information notice. If your phone call is aimed at requesting information on our products or reporting a complaint or adverse event, the data provided by you are retained for at least 10 years from the date of your request or report.

Your data is accessible to the competent Authorities for the supervision of adverse events and to the health authorities as required by applicable law; to the companies of the Menarini Group and the related staff authorized to process personal data; to the Companies from which the products in question have been taken or licensed; service providers who support us in the management of adverse events; other legitimate recipients pursuant to the law. We may also use the data to ascertain, exercise, defend a right in court.

In relation to the possible transfer of your data to countries outside the European Union, including countries that may not offer the same level of protection as Europe, we inform you that such transfer will take place according to one of the methods and/or circumstances provided for by the Regulation, such as, for example, the adoption of the Commission's Standard Contractual Clauses, the selection of partners who adhere to programs for the free exchange of data (e.g. Privacy Shield with the USA) or who reside in countries considered safe by the European Commission.

 

By sending a request to the Data Controller or DPO at the contacts indicated above, you may receive the list of recipients of your data, data controllers and/or exercise the rights provided for by articles 15-22 of the Regulation as applicable, including for example the right to obtain confirmation on data processing operations, verify their content, verify the origin, accuracy, location of the data, obtain a copy, request that your data be integrated, updated, rectified, anonymized, etc. Finally, we remind you that you have the right to appeal to the Data Protection Authority.
